1. Acceptance of the Terms By accessing and using the website [casacabure.com] (the “Site”) and/or making a booking to stay at Casa Caburé, you (hereinafter, “the Guest”) agree to be legally bound by these Terms and Conditions of Service (the “Terms”), our Privacy Notice, and all applicable regulations in the United Mexican States. If the Guest does not agree to any part of these Terms, they must discontinue use of the Site immediately and not proceed with any booking.
2. Service Description Casa Caburé, with its address at México 175, Los Mangos 20, Playa Zipolite, 70902 Zipolite, Oaxaca, Mexico, provides accommodation services. The descriptions, images, and prices of rooms and services on the Site are provided for general reference and may not reflect exact details at the time of your stay. We reserve the right to modify or discontinue any service without prior notice.
3. Bookings, Payments, and Taxes All bookings are subject to availability and confirmation by Casa Caburé. The Guest agrees to provide complete and accurate contact and payment information. Prices are quoted in Mexican Pesos (MXN) and include applicable taxes. Casa Caburé may require a deposit or full payment in advance to confirm the booking. We reserve the right to refuse or cancel any booking at our sole discretion.
4. Cancellation Policy All bookings are subject to availability and confirmation. As we currently do not require online payments or deposits to secure bookings, we operate on the good faith of our guests. We ask that you cancel your reservation as far in advance as possible of your scheduled arrival date by notifying us in writing at [email protected]. This advance cancellation allows us to offer the room to other guests and is essential for our planning.
5. Check-In and Check-Out
Check-In: From 3:00 PM.
Check-Out: Before 12:00 PM. Late check-outs are subject to availability and may incur additional charges.
6. Guest Conduct and House Rules The Guest agrees to respect the facilities, other guests, and staff of Casa Caburé. The Guest will be financially responsible for any damages caused to the hotel property during their stay. Casa Caburé reserves the right to deny access or expel, without refund, any guest whose behavior is disruptive, dangerous, or illegal.
7. Local Environment and Safety The Guest acknowledges that Zipolite beach is known for its strong currents. It is highly recommended to swim with extreme caution, heed lifeguard flags and warnings, and avoid swimming alone or under the influence of alcohol. Casa Caburé is not responsible for accidents or incidents occurring on the beach or in public areas.
8. Limitation of Liability To the fullest extent permitted by law, Casa Caburé shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or use, resulting from your access to or use of the Site or our services. This limitation applies to all claims, including those based on warranty, contract, tort, and any other legal theory.
9. Intellectual Property All content on the Site, including text, graphics, logos, images, and data compilations, is the property of Casa Caburé or its content suppliers and is protected by the copyright and intellectual property laws of Mexico and international treaties. Reproduction, distribution, or creation of derivative works without our express written permission is prohibited.
10. Governing Law and Jurisdiction These Terms shall be governed and construed in accordance with the laws of the United Mexican States. For any dispute arising from these Terms, the parties shall expressly submit to the jurisdiction of the competent courts of San Pedro Pochutla, Oaxaca, Mexico, with express waiver to any other jurisdiction that may correspond to them.
11. Modifications to the Terms We reserve the right to update, change, or replace any part of these Terms at our sole discretion. We will post any changes on this page and update the “Last Updated” date. It is the Guest’s responsibility to check this page periodically for changes. Continued use of the Site or Casa Caburé’s services following the posting of changes constitutes acceptance of those changes.
